1. Introduction
- Welcome to Allypay.in . These Terms & Conditions govern your access to and use of our Secure Payment Holding Service (also referred to as “Transaction Management System”). By using our platform, you agree to comply with these terms.
- We act as a payment facilitator that securely holds funds until both parties (buyers and sellers) fulfill their transaction obligations. We are not a bank or a financial institution but work with regulated partners to ensure secure and transparent transactions.
2. Service Description
- Our platform provides a secure transaction management system where payments are held until the agreed-upon conditions between buyers and sellers are met.
- We partner with authorized financial institutions to manage transactions securely.
- We do not offer lending, banking, or financial investment services.
3. User Responsibilities
- Users must provide accurate personal and business information during registration.
- The platform must not be used for illegal, fraudulent, or unethical activities.
- Users are responsible for ensuring their transactions comply with applicable laws.
- Any disputes arising from transactions should be resolved as per our Dispute Resolution Policy.
4. Payment & Transaction Policy
- Funds deposited into the Secure Holding Account remain in escrow until both parties confirm the transaction’s completion.
- Payments will be released only when the buyer confirms delivery and satisfaction with the product or service.
- If a dispute arises, funds may be held until the issue is resolved following our dispute policy.
- We do not guarantee product or service quality, as we act only as a transaction facilitator.
5. Fees & Charges
- A service fee is applicable for using our transaction management platform.
- Fees are transparently displayed during transactions, and no hidden charges apply.
- A dispute resolution fee may apply if additional investigation or legal intervention is required.
- All applicable taxes (if any) will be charged separately.
6. Refund & Dispute Resolution Policy
- If a buyer is dissatisfied with the transaction, they must raise a dispute within 30 days of payment.
- Both parties must provide relevant proof (invoices, screenshots, or tracking details) to resolve the issue.
- Refunds will be issued only if the buyer presents a valid reason and the claim is verified.
- We act as a neutral third-party in disputes and reserve the right to make final decisions.
7. Account Termination & Restrictions
- If a user is found engaging in fraud, unethical practices, or repeated disputes, their account may be permanently suspended.
- We reserve the right to block or terminate any account involved in suspicious activities.
- Any violation of our terms may result in the loss of access to our services.
8. Limitation of Liability
- We are not responsible for direct or indirect financial losses resulting from fraudulent transactions.
- We do not act as a seller, buyer, or intermediary in transactions but only facilitate payments securely.
- Users agree that Allypay.in is not liable for any disputes related to the quality of goods or services exchanged.
- AllyPay’s total liability is limited to the escrow service fees paid within three (3) months preceding the cause of action.
9. Privacy & Data Security
- We value user privacy and ensure that personal information remains confidential.
- No user data will be shared with third parties without explicit consent, except where required by law.
- Our platform uses secure encryption methods to protect transactions and user data.
10. Governing Law and Dispute Resolution
- Any disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.
- The seat and venue of arbitration shall be Gurugram, Haryana, and proceedings will be conducted in English.
- The courts of Gurugram, Haryana, shall have exclusive jurisdiction over any disputes.
11. Changes to Terms & Conditions
- We reserve the right to modify these terms at any time.
- Users will be notified of any significant changes, and continued use of the platform constitutes acceptance of updated terms.
